Terms and Conditions
By placing this order, Customer acknowledges that they have read, understand, and agree to the following Terms & Conditions.
1. Weight Allowance & Overage Charges
Each dumpster rental includes the weight allowance specified for the selected container size. Any material exceeding the included weight allowance will be billed at $110.00 per additional ton, prorated as applicable. Customer authorizes Lombardo Iron & Metal to charge any applicable overweight fees to the payment method on file.
2. Acceptable Materials
Unless otherwise approved in advance by Lombardo Iron & Metal, the dumpster may only be used for the material type selected at the time of ordering (including, where applicable, construction and demolition (C&D) debris, scrap metal, or other approved materials).
The following materials are prohibited unless prior written approval has been obtained from Lombardo Iron & Metal: hazardous waste, asbestos, chemicals, liquid waste, paint, oils, fuels, batteries, tires, propane tanks, medical waste, radioactive materials, appliances containing refrigerants, and any other material prohibited by applicable law or disposal facility requirements.
Lombardo Iron & Metal reserves the right to inspect any container and refuse pickup of any load containing unauthorized or prohibited materials until such materials have been removed by the Customer at the Customer’s expense.
Customer is responsible for all costs associated with the removal, transportation, disposal, cleanup, regulatory fines, administrative fees, and damages resulting from the placement of unauthorized or prohibited materials in the dumpster.
3. Heavy Materials
Concrete, brick, block, asphalt, dirt, stone, roofing shingles, and other dense materials require prior approval and may require a dedicated dumpster. Additional charges may apply if these materials exceed the included weight allowance or are loaded into an inappropriate container.
4. Loading Requirements
Materials must not extend above the top edge of the dumpster. Containers must be loaded safely and evenly to allow for legal transportation. Overloaded or unsafe containers will not be removed until corrected. Additional trip charges may apply.
5. Surface Protection & Property Damage
Lombardo Iron & Metal will use reasonable care when delivering and removing dumpsters and will make every reasonable effort to minimize damage to driveways, sidewalks, curbs, lawns, trees, shrubs, landscaping, and other property.
Customer understands that roll-off trucks and dumpsters are extremely heavy and require sufficient clearance for safe operation. Normal delivery and pickup may involve travel over paved or unpaved surfaces and may require maneuvering near trees, shrubs, fences, mailboxes, landscaping, or other improvements. Despite the exercise of reasonable care, cracking, rutting, settling, scraping, staining, broken branches, disturbed landscaping, or other property damage may occur.
Customer accepts all risks associated with the requested placement location and access route and releases Lombardo Iron & Metal from liability for ordinary property damage resulting from normal delivery and pickup operations.
6. Placement Authorization
Customer represents that they have the authority to authorize placement of the dumpster at the requested location and accepts responsibility for any damage resulting from that placement.
7. Access Requirements
Customer shall provide safe and unobstructed access for delivery and pickup. If service cannot be completed due to blocked access, parked vehicles, locked gates, overhead obstructions, soft ground, weather conditions, or other site conditions beyond the control of Lombardo Iron & Metal, additional trip or waiting charges may apply.
8. Underground Utilities & Hidden Structures
Customer is solely responsible for identifying underground utilities, septic systems, irrigation systems, drain fields, utility covers, tanks, and any other concealed structures that could be affected by the weight of the truck or dumpster.
9. Rental Period
The rental includes the rental period selected at checkout. Additional rental days will be billed at Lombardo Iron & Metal’s current daily rental rate unless otherwise agreed in writing.
10. Customer Responsibility
Customer is responsible for the dumpster from the time it is delivered until it is removed by Lombardo Iron & Metal. This includes preventing unauthorized use, overloading, prohibited materials, fire damage, theft, vandalism, or damage to the container beyond ordinary wear and tear. Customer agrees to reimburse
Lombardo Iron & Metal for repair or replacement costs resulting from misuse, negligence, or intentional acts.
11. Payment Authorization
Customer authorizes Lombardo Iron & Metal to charge the payment method on file for all applicable charges, including but not limited to:
- Rental charges
- Overweight charges ($110.00 per additional ton)
- Additional rental days
- Dry-run or return trip charges
- Contamination or prohibited material charges
- Damage caused by prohibited materials
- Repair or replacement costs for damaged containers
- Any other charges incurred under these Terms & Conditions
12. Photo Documentation
Customer acknowledges that Lombardo Iron & Metal may photograph the delivery location, dumpster placement, pickup location, and container contents before and after service for quality assurance, documentation, and dispute resolution.
13. Billing Disputes
Customer agrees to notify Lombardo Iron & Metal in writing of any disputed charge within 10 calendar days of the invoice or credit card charge. Failure to provide timely notice shall constitute acceptance of the charges.
14. Service Delays
Lombardo Iron & Metal reserves the right to delay, reschedule, or refuse delivery or pickup due to unsafe conditions, severe weather, equipment failure, governmental restrictions, or other circumstances beyond its reasonable control.
15. Limitation of Liability
To the fullest extent permitted by applicable law, Lombardo Iron & Metal shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the delivery, placement, use, or removal of the dumpster. Lombardo Iron & Metal’s total liability for any claim shall not exceed the amount paid by the Customer for the rental giving rise to the claim.
16. Governing Law
These Terms & Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania.
17. Electronic Acceptance
By submitting this order electronically, Customer acknowledges that they have read, understand, and agree to these Terms & Conditions. Electronic acceptance shall have the same force and effect as a handwritten signature.
